If you do not agree to any of these terms, you may not use the website. These terms of use (“terms”) set out the terms and conditions of use of the website “suboost.com” (meant collectively, including all content and functionality available through the suboost.com website, the “website”), published by Wygwam™. If you are not an individual, you agree that you have all necessary corporate or equivalent authority and power to agree to the terms that will be binding your organization or equivalent.

2. Suboost website

Suboost.com is an original free video website that enables users to access, view, store, share and comment upon personal videos hosted on another website. The Website is not designed as a video back-up service, you are then responsible for taking all necessary precautions to back-up your files. Advertisements may be incorporated into the Website. Revenues generated by such advertisement is sole ownership of Wygwam™.

3. Users’ Intellectual Property rights

Wygwam™ does not own your content. By making your content accessible to other users, you agree to allow any users of the Website to view and transmit Your Content on or through the Website, and any other electronic communication media or technology, for the entire period in which Your Content is hosted on the Website. Please note that due to the nature of the Internet and digital media, data transmitted – including Your Content - are not protected against the risks of misappropriation and/or piracy, for which Wygwam™ shall not be liable. You are responsible for taking all appropriate steps to protect such data, where applicable. As long as Your Content is accessible on or through the Website, you grant Wygwam™ the non-exclusive, royalty free right and license to reproduce and display Your Content, in whole or in part, and to display, perform, distribute and transmit the same via the features that enable the Website to be accessed both on the Internet and through any other electronic communication media or technology, and to adjust the format of Your Content as necessary for the purposes of reproduction, display and transmission. If other users of the Website have provided other content subject to the Terms and policies of the Website, you may access other users’ content for your information and personal use.

4. Wygwam™’s Intellectual Property rights

The Website and its content – other than users’ content - is the exclusive property of Wygwam™. Wygwam™ grants you a free, personal, non-exclusive and non-transferable right to access and use the Website, which right is conditioned on your compliance with the Terms. All other rights are expressly excluded without our prior written consent. Wygwam™’s Content may not be copied, reproduced, downloaded, distributed, transmitted, displayed, licensed or sold, without the prior written consent of Wygwam™. You are not allowed to adapt, reverse engineer, decompile, disassemble, modify, enhance, edit, translate, , or create derivative works based upon or otherwise alter in part or in full any Wygwam™ Content. All rights not expressly granted in the Terms are reserved to Wygwam™.

5. Wygwam™’s liability as host

Wygwam™ is under no legal obligation to monitor content transmitted via or stored on the Website. Our only obligations as host concern :

• the retention of your connection data, which is moreover subject to an obligation of confidentiality and treated in compliance with the laws and regulations relating to Personal Data,
• the fight against certain content in accordance with the procedure described in the Prohibited Content section,
• the removal of all clearly illegal content which has been effectively brought to our attention.

6. Your liability as user

As a supplier of content on the Website (including videos, comments on videos, your nickname), you warrant that Your Content :

• contains no child pornography; dangerous or illegal acts; images of violence, animal or drug abuse, bestiality, rape or abuse; or any sexually explicit content. Wygwam™ does not tolerate such content. You are not authorized to publish such content to the Website.
• does not infringe personal rights (i.e. it is not defamatory and does not contain insults, abuse, libel, etc.) or personal privacy (including an individual's right to his or her image);
• is not contrary to public policy and accepted moral standards and does not display, incite or otherwise promote illegal or immoral activity, and does not violate any applicable laws or regulations.
• does not infringe the intellectual property rights of any third party (including but not limited to sound, music, television shows, films, advertisements or any other material that you have not created yourself or for which you do not have the necessary clearances and permissions from third party rights owners or copyright royalty collection organizations in such materials);

Failure to comply with these provisions may result in Your Content being removed and/or your account being deactivated without prior notice. In addition, Wygwam™ reserves the right to report any violation of these provisions to applicable legal authorities and you may be personally liable to criminal sanctions applicable to the content in question in addition to any applicable civil damages.

7. Registration and access

In order to use the Website's features, you must set up an account using the online registration form. You are free to modify the Personal Data you provide on the form at any time.
